SECTION 5 - PRODUCTS AND INTERNATIONAL SALES

  1. Display: We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your monitor's display will be accurate.
  2. Taxes & Duties: For international orders (including USA and Australia), you the customer are the "importer of record" and are responsible for any import duties, taxes, or customs clearance fees levied by your country.

EU VAT: Where applicable, prices shown will include VAT at the prevailing rate unless otherwise stated during checkout.

SECTION 6 - CUSTOM PRODUCTS AND PERSONALIZED ORDERS

  1. Production & Lead Times: Custom items are handcrafted to your specific requirements. Production times are estimates and may vary based on design complexity and seasonal demand.
  2. Design & Media Usage: SRGEARS reserves the right to use photographs or videos of your custom product (including finished products and production footage) for marketing, social media, and website display purposes unless you explicitly request otherwise in writing before production begins.
  3. Accuracy of Specifications: You are responsible for providing accurate measurements, patches, and design details. SRGEARS is not liable for fitment issues or design errors resulting from incorrect information provided by the customer.
  4. Cancellations & Refunds: Once production on a custom item has started, the order cannot be canceled. Because these items are tailored to your unique specifications, custom products are non-refundable and exempt from our standard return policy.

SECTION 7 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. You agree to provide current, complete and accurate purchase and account information.

SECTION 8 - SHIPPING AND DELIVERY

To fulfill your order, we share your Name, Shipping Address, and Phone Number with our third-party courier partners. Delivery times are estimated and not guaranteed. SRGEARS is not responsible for delays caused by customs processing or local courier issues.

SECTION 9 - REFUNDS AND CONSUMER GUARANTEES

Your purchases are subject to our Refund Policy.

  • EU: You may have statutory rights to return eligible items within the required legal period, provided items are returned in original condition.
  • Australia: Our goods come with guarantees that cannot be excluded under applicable consumer law. You are entitled to a replacement or refund for a major failure and compensation for reasonably foreseeable loss or damage.

SECTION 10 - PERSONAL INFORMATION

Your submission of personal information through the store is governed by our PRIVACY POLICY. This includes our practices regarding the sharing of data with courier services for order fulfillment.

SECTION 13 - GOVERNING LAW AND DISPUTE RESOLUTION

Governing Law: These Terms shall be governed by the laws of Spain.

Disputes: Any disputes will be subject to the exclusive jurisdiction of the courts of Spain, without prejudice to your mandatory local consumer rights if you reside in the EU or Australia.

SECTION 14 - SEVERABILITY

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will continue in full effect.

SECTION 15 - TERMINATION

We may terminate this agreement at any time if you violate any terms. All obligations prior to termination remain in effect.

SECTION 16 - ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and SRGEARS and replace all prior communications or agreements.

We reserve the right to update these Terms at any time. Continued use of the website means acceptance of any changes.
